PNEUMOCONIOSIS (COMPENSATION) (AMENDMENT) BILL 1988

A BILL
To
Amend the Pneumoconiosis (Compensation) Ordinance.
Enacted by the Governor of Hong Kong, with the advice and consent
of the Legislative Council thereof.
1. This Ordinance may be cited as the Pneumoconiosis (Compensa- Short title tion) (Amendment) Ordinance 1988.

Section 17 of the Pneumoconiosis (Compensation) Ordinance is Distribution of amended by repealing subsection (4) and substituting-
"(4) The Board may pay from the Fund an amount not exceeding $20,000 direct to a person or a dependant on account of a claim which is pending settlement or determination.
(4A) The Commissioner may order that a payment under subsec- tion (4) or a part of it shall be deducted from the compensation payable under this Ordinance to the person or dependant.".
Explanatory Memorandum
The amendment to section 17 is to clarify and enhance the Board's power to make an advance on account of compensation claimed under the principal Ordinance from $1,000 to $20,000.
