Explanatory Memorandum
The purpose of this Bill is to increase the maximum fine that may be imposed by a court for offences under the Employment Ordinance and its subsidiary legislation, namely, the Employment Agency Regulations, the Employment of Children Regulations and the Women and Young Persons (Industry) Regulations. The Bill results from a re-assessment of the gravity of the offences created by the enactments. Fines prescribed for these offences are increased in accordance with this re-assessment.
2. To keep in line with the revised fine levels, a new section 74 is added to replace section 73(3) of the Ordinance. The new section authorizes the imposition of fines not exceeding $20,000 in regulations under the Ordinance, including those made under section 62.
3. The opportunity is taken to delete sections 59(3) and 63(5A)(c) of the principal Ordinance as their effect is already covered by section 23 of the Summary Offences Ordinance (Cap. 228).
