2.
Now it is Hereby Agreed as follows :
1. The Secretary of State undertakes that
that the Inspectorate
will during the continuance of this Agreement perform the duties
more particularly set out in the First Schedule hereto in
respect of the Railway and any extensions thereto whenever
required to do so by the H.K. Government.
2. The Secretary of State undertakes that he will during the
continuance of this Agreement and for the period of
of 5 years
thereafter :
(i) not without the prior consent in writing of the H.K.
Government disclose or permit the disclosure of any
information obtained as a result of this Agreement or the
implementation thereof concerning the operation or
construction of the Railway to any person or body not
otherwise authorised in writing by the H.K. Government to
receive such information;
(ii)
take all reasonable precautions in dealing with all
information documents and papers submitted to him by the
H.K. Government and with the originals and copies of any
reports documents papers or information or draft reports:
documents and papers
submitted or provided by the
Inspectorate to the HK Government so as to prevent any
unauthorised erson from having access to such
information documents reports or papers.
