Amendment of section 146.
SECURITIES (AMENDMENT)
(3A) In subsection (1) "function" includes a power and a duty."; and
(b) by deleting subsection (7) and substituting the following—
3.
"(7) Any person who contravenes subsection (1) or (3) shall be guilty of an offence and shall be liable—
(a) on conviction on indictment to a fine of $100,000
and to imprisonment for 2 years; or
(b) on summary conviction to a fine of $50,000 and to
imprisonment for 6 months.
(8) Any person who, without lawful authority or rea- sonable excuse, contravenes subsection (4) or (6) shall be guilty of an offence and shall be liable on conviction to a fine of $10,000 and to imprisonment for 6 months.".
Section 146(1)(q) of the principal Ordinance is amended by delet- ing “sections 19 and" and substituting the following-
1988.
"section".
