CLAUSE 3: PRIVILEGES AND IMMUNITIES
This clause gives effect in British law to the privileges and
immunities of MIGA, its officials and its property as set out in
the articles of the Convention stated in the clause. These include
immunity from attachment of MIGA's property pending a final judgement of the courts in any action against MIGA; immunity of assets from search, requisition, confiscation or expropriation;
freedom from restrictions, regulations, controls and moratoria on property and assets; inviolability of its archives; immunity from taxes and customs duties; and immunity of staff from legal process in respect of acts performed in their official capacity.
As members of MIGA we shall be under an obligation to provide these privileges and immunities, which are the basic minimum necessary to
ensure the unencumbered work of the agency.
