However, as a result of representations made by the

professions, it is now considered it would be too drastic to thus

shut out a late objection to evidence, which might otherwise be

meritorious. Thus under an amendment to be made at the committee

stage, subfclause (5) is to be replaced by a provision which would

instead authorise the judge specifically to order the accused to pay

to the prosecutor the additional costs thus incurred.

Sir, the present Bill with the proposed committee stage

three amendments represents the final distillation of over

years work.

I think it achieves the object of reform in this very difficult area

without sacrifice of principle. I am happy to support the motion.
