HONG KONG: DRUG TRAFFICKING OFFENCES ACT

1.

2.

Thank you for your minute of 25 August.

73

Looking through our files, I see from a letter from Michael Thomas, Attorney General in Hong Kong, to Mr Richardson of ERD (written on 20 July) that Hong Kong have not yet introduced an Ordinance based on the UK Drug Trafficking Offences Act but that

Mr Thomas they expect to do so later this year or early next year. points out that the Hong Kong Government have only just begun their policy consideration of the legislation and that the degree to which they may depart from the UK Act is not yet known.

ERD

Meanwhile, there are legislative proposals in Hong Kong for a mutual legal assistance scheme whereby Hong Kong would enter into reciprocal agreements with other governments for the purpose of tracing, freezing and seizing the assets of drug traffickers. have already supplied Hong Kong with information on this aspect, and

Hong I presume that their letter to Mr Broadley covers this area. Kong's proposals are still at an embryonic stage and it is too soon to predict the outcome.

4.

I hope this information is of some help; do not hesitate to ask if you have any further questions.
