Alternatively, if HKG considers it desirable to remove a prisoner under this Act, HKG may also initiate by the following procedure

HKG will give a provisional indication to the FCO that we wish a prisoner to be removed to the UK.

The FCO will consult the Home Office or its equivalent whether it is prepared to accept the person to be removed into custody in a prison in the UK.

If the Home Office is prepared to accept the person to be removed, the FCO inform the Secretary for Security, HKG, of the provisional acceptability of the removal.

After the initiation step, procedures would be taken as follows

The Secretary for Security will arrange to seek the concurrence of the Executive Council to the removal of the person concerned to serve the remainder of his prison sentence in the United Kingdom.

removal, the Secretary for Security will inform the Foreign and Commonwealth Office by telegram and the latter will arrange for a Removal Order, signed by the Secretary of State, to be forwarded to the Secretary for Security, Hong Kong.

When the Governor receives the Removal Order he will sign a Notification of Concurrence in duplicate. One copy will be forwarded to the Foreign and Commonwealth Office and one copy retained in Hong Kong.

The relevant Secretary of State will sign a Warrant of Reception in order to enable the prisoner to be received into the custody of the United Kingdom authorites. The Secretary for Security, Hong Kong Government, should be informed by telegram when the Warrant has been signed.

The Governor will sign a Removal Warrant which will enable the prisoner to be removed to the United Kingdom. The Removal Warrant will at all times remain in the hands of those who have charge of the prisoner.
