You swift response has taken us by surprise! But I am very pleased to have your agreement on the proposed procedures. Regrettably in the interim our legal advisers have pointed out that while the proposed procedures are legally in order, they are unduly cumbersome. I would now like to streamline the proposed procedures and eliminate unnecessary steps.
The proposed amendments to the procedures are
as follows
(a)
(b)
sub-paras 4(a) & 5(b) - if a prisoner is taken to a prison in Scotland or North Ireland, I think the reference should be made to the respective office. Therefore I have added after the Home Office "(or the Scottish or North Ireland Offices as the case may be)" at para 4(a) and "or its equivalent" at para 5(b);
sub-para 6(a) substitute "concurrence" for "advice" and "to the removal of" for "as to the acceptability of removing". This is because when the matter is put to ExCo, the Ex Co memorandum will conclude by seeking the
concurrence of ExCo to the transfer and thus it is better to follow the same wording in the procedures;
(c) sub-para 6(b)

substitute "advises that" with "concurs in" and delete "is acceptable";
