As stated in paragraph 6 above, an amendment requiring Crown servants to assist in making an arrest has been omitted, as has a new Schedule of corruption related offences for which Commission Officers may make arrests (paragraphs 22 to 24
24 of the memorandum at Annex C). There remains an amendment to section 10(5) of the principal Ordinance which adds to the list of offences specified in that subsection four new offices which have been resulted from the reclassification of the existing offence of obtaining pecuniary advantage by deception in the Theft Ordinance (Clause 4 of the Bill). proposed new section 10AA giving power to Commission Officers to rearrest persons likely to break bail also remains (paragrpah 25 of the memorandum at Annex C) as Clause 6 of the Bill. Members will recall that police officers have similar powers under the Criminal Procedure Ordinance.
