BROADCASTING AUTHORITY

14. (1) Subject to subsection (2), the Authority may by resolution, with or without restrictions or conditions as it sees fit, delegate in writing to the principal executive officer any of its powers and functions.

(2) The Authority shall not delegate to the principal executive officer any of its powers or functions under-

(a) this section or section 10, 12 or 15; or

(b) section 8, 13, 14, 15, 20, 28, 35, 36, 36A or 37 of the Television

Ordinance.

15. (1) The Authority shall submit to the Governor, at least once in each year, a report on the progress of television broadcasting in Hong Kong, which report shall be accompanied by any Codes of Practice then in

use.

(2) Every report under subsection (1), together with any accompany- ing Codes of Practice, shall be tabled in the Legislative Council.

16. No liability shall be incurred by—

(a) the Authority;

(b) any member of the Authority;

(c) any member of any committee of the Authority; or

(d) any public officer,

as a result of any thing done or omitted to be done by the Authority or such member or officer in good faith in the exercise or purported exercise of powers conferred or functions imposed by or under this Ordinance, the Television Ordinance or any other Ordinance.

PART IV

CONSEQUENTIAL AND OTHER AMENDMENTS

17. (1) The provisions of the Television Ordinance set out in the second column of Part I of the Schedule are amended in the manner and to the extent set out in the third column of that Part.

(2) The provisions of the Television (Advertising) Regulations set out in the second column of Part II of the Schedule are amended in the manner and to the extent set out in the third column of that Part.

(3) The provisions of the Television (Standards of Programmes) Regulations set out in the second column of Part III of the Schedule are amended in the manner and to the extent set out in the third column of that Part.

(4) Section 13 of the Smoking (Public Health) Ordinance is amended- (a) in subsection (1), by deleting "Television Authority appointed under the Television Ordinance" and substituting the following— "Broadcasting Authority established by the Broadcasting Authority Ordinance 1987".

(b) by inserting, after subsection (4), the following-

"(5) Any Code of Practice issued under this section and in use immediately prior to the commencement of the Broad- casting Authority Ordinance 1987—

(a) shall be deemed for all purposes to have been issued

by the Broadcasting Authority under this section;

(b) subject to paragraph (c), shall remain in use; and

(c) may be amended or withdrawn by the Broadcasting

Authority.".

(5) The Schedule to the Prevention of Bribery Ordinance is amended (Cap. 201.) by adding after item 48 the following item—

AMENDMENTS TO THE TELEVISION ORDINANCE

(a) Delete the definition of "Board".

(b) Insert, after the definition of "broadcasting", the

following-

"Broadcasting Authority" means the Broad- casting Authority established by section

3 of the Broadcasting Authority Ordin- ance 1987;".

(c) In the definition of "Code of Practice" delete

"Television" and substitute "Broadcasting”.

Delete the Part.

(a) In subsection (1), delete "Television" and substitute

"Broadcasting".

(b) In subsection (2), delete "Government at such place and within such time as may be determined by the Television Authority" and substitute "Broadcasting Authority at such place and within such time as may be determined by the Broadcasting Authority". Delete "such persons as he thinks fit" and substitute "the Broadcasting Authority".

Delete", this period being not less than 15 years from the date on which it is granted".

Delete "Television" wherever it occurs and substitute "Broadcasting".

Delete and substitute the following—

"(1) A licensee shall not, except in respect of material for broadcasting for the supply of which it is contracting, agree to broadcast or to refrain from broadcasting any material.".

(a) In subsection (1), delete "Board" and substitute

"Broadcasting Authority”.
