COUNTERFEIT CURRENCY (CONVENTION) ACT 1935

I attach copies of correspondence from Hong Kong, about their using the English Forgery and Counterfeiting Act 1981, as a model for drafting more up to date legislation in Hong Kong.

Mr Fifoot has given me some guidance (copy attached) but has suggested that NTD should be able to confirm whether Hong Kong was the sole exception to the 1960 extension (of the 1929 Convention and the 1935 Act) to the Dependent Territories.

I should be most grateful if you, or your legal advisers, could provide clarification of the issue, please.

In your minute above you ask for confirmation that Hong Kong was the sole exception to the 1960 extension of the 1929 Convention to the Dependent Territories. A search into our Treaty Records has revealed the following:

(a)

the UK did not ratify the Convention until 1959 and ratification did not include Hong Kong;

(b) Hong Kong was not included in the 1960 list extending the

Convention to the Dependent Territories, nor has the Colony been extended to it since (list attached taken from TS 87(1960);

Barbados was extended in 1963, therefore Hong Kong would not appear to be the "sole exception"**There may be other dependent territories which were also not included but a list of such territories as at 1960 would be needed in order to check against the 1960 extension list; (Barbados details taken from TS(1963) attached);

as far as we can tell there is no mention of any declaration concerning Hong Kong. (We have a reference to United Nations Department file No UNS 1652/2/60 which presumably carries details of the 1960 extension list to the dependent territories. This file may be of some help to you.)
