PENALTIES FOR PRACTICE OF MEDICINE AND DENTISTRY BY UNREGISTERED PERSONS (MISCELLANEOUS AMENDMENTS)
PART IV
AMENDMENTS TO THE DENTISTS REGISTRATION ORDINANCE
Section 3(1) of the Dentists Registration Ordinance is amended-
(a) by deleting "who practises dentistry within Hong Kong shall be guilty of an offence and shall be liable on summary conviction to a fine of $1,000 and to imprisonment for 6 months." and substituting the following-
"who-
(a) practises dentistry within Hong Kong commits an offence and
is liable-
(i) on summary conviction to a fine of $50,000 and to imprisonment for 12 months; or
(ii) on conviction upon indictment to imprisonment for 3
years; or
(b) practises dentistry on a person within Hong Kong which results in personal injury to that person commits an offence and is liable
(i) on summary conviction to a fine of $100,000 and to imprisonment for 2 years; or
(ii) on conviction upon indictment to imprisonment for 5 years."; and
(b) by inserting after subsection (2) the following-
"(3) For the purposes of this section a person who fraudulently procures himself to be registered under this Ordinance shall be deemed not to have been so registered.".
10. Section 10 of the Dentists Registration Ordinance is amended-
(a) in subsection (3)(e) by deleting "shall be guilty of an offence and shall be"
and substituting the following---
"commits an offence and is"; and
(b) in subsection (5) by deleting "shall be guilty of an offence and shall be" and
substituting the following-
"commits an offence and is".
11. Section 12 of the Dentists Registration Ordinance is amended—
(a) in subsection (2) by deleting "shall, unless he proves that the offence was committed without his knowledge, be guilty of an offence and shall be liable on summary conviction to a fine of $2,000 for each offence" and substituting the following-
"subject to subsection (2A), commits an offence and is liable on summary conviction to a fine of $2,000 for each offence"; and
(h) by inserting after subsection (2) the following---
"(2A) Where a person is charged with an offence under subsection (2) by reason of being a director or manager, it shall be a defence for him to prove that the offence alleged to be committed by the body corporate was committed without his knowledge.".

12. Section 14 of the Dentists Registration Ordinance is amended-
(a) in subsection (1) by deleting "shall be guilty of an offence and shall be" and
substituting the following--
"commits an offence and is"; and
(b) in subsection (2) by deleting "shall be guilty of an offence and shall be” and
substituting the following--
"commits an offence and is".
Amendment of section 14.
13. Section 16(2) of the Dentists Registration Ordinance is amended by deleting Amendment of "shall be guilty of an offence, and shall be" and substituting the following—
"commits an offence and is".

14. Section 20 of the Dentists Registration Ordinance is amended by deleting Amendment of "shall be guilty of an offence and shall be" and substituting the following--
"commits an offence and is".

15. Section 24 of the Dentists Registration Ordinance is amended by deleting Amendment of "shall be guilty of an offence and shall be liable on summary conviction to a fine of section 24. $10,000 and to imprisonment for 2 years" and substituting the following-
"commits an offence and is liable on conviction upon indictment to imprison- ment for 3 years".
16. Section 25 of the Dentists Registration Ordinance is amended by deleting Amendment of "shall be guilty of an offence and shall be liable on summary conviction to a fine of section 25. $1,000" and substituting the following-
"commits an offence and is liable on summary conviction to a fine of $10,000”.
17. Section 26 of the Dentists Registration Ordinance is amended by deleting Amendment of "shall be guilty of an offence and shall be" and substituting the following-
"commits an offence and is".

18. Section 27 of the Dentists Registration Ordinance is amended by deleting Amendment of "shall be guilty of an offence and shall be" and substituting the following-
"commits an offence and is".
