DUTIABLE COMMODITIES (AMENDMENT)
10. The principal Ordinance is amended by adding after section following-
"Books and documents.

11A. (1) Any book or document kept in pursuance of this Ordinance shall be kept in a legible form or in a non-legible form capable of being reproduced in a legible form.
(2) If any book or document is kept otherwise than in a legible form, any power conferred by this Ordinance to require the produc- tion of such book or document, to remove and detain it for the purpose of examination, to examine it or to take copies of it shall be construed as including power to require production of it, to remove it and to detain it for the purpose of examination, to examine or to take copies of a reproduction of the book or document or of the relevant part of it in a legible form.".
11. Section 14 of the principal Ordinance is amended—

in subsection (1)———
(i) by deleting "or any premises";
(ii) in paragraph (a) by deleting "or the premises”; and
(iii) in paragraph (b) by deleting "or in such premises”;
(b) in subsection (2)—
(i) in paragraphs (a) and (b) by deleting "or the premises" wherever it
occurs;
(ii) in paragraphs (d) and (e) by deleting "or such premises" wherever it
occurs;
(c) in subsection (3) by deleting "or any premises". "or the premises” and “or
such premises"; and
(d) by deleting subsection (4).
12. Section 15(1) of the principal Ordinance is amended by inserting after "seize", wherever it occurs the following-
remove and detain".
13. Section 17 of the principal Ordinance is amended-
(a) in subsection (3) by inserting after "or supply," the following-
"or possess for sale or supply,”;
(b) in the proviso to subsection (3) by deleting "and transhipment cargo or in
the case of the export of transhipment";
(c) in subsection (5) by inserting after "or supply" the following-
(d) in subsection (6)———
". or possess for sale or supply.":
(i) in paragraph (b)—
(A) by deleting the full stop at the end of sub-paragraph (iv) and
substituting the following--
"; or"; and
(B) by inserting after sub-paragraph (iv) the following —
"(v) in a place approved by the Commissioner under section 28A.”; and
(ii) by deleting the sentence commencing "It shall be"; and
(e) by inserting after subsection (9) the following-
"(10) It shall be no defence to any charge under this section that the possession or control of the accused was a joint possession or control.".
DUTIABLE COMMODITIES (AMENDMENT)
Section 22 of the principal Ordinance is amended--

(a) in subsection (2) by deleting "within 12 hours after such arrival or within 7
days after such departure" and substituting the following—
"within 7 days or such longer period as the Commissioner may specify, after such arrival or departure";
(b) in subsection (3) by deleting "the prescribed form” and substituting the
following-
"a form approved by the Commissioner"; and
(c) by inserting after subsection (5) the following-
"(6) The Commissioner may, with respect to any case or class of cases, grant in writing exemptions from any of the requirements of this section and may impose conditions with respect to such exemptions.".
15. Section 25(2) of the principal Ordinance is amended-- (a) by inserting after "section" the following—
"the Commissioner, any member of the Customs and Excise Service or"; and
(b) by deleting "such officer" and substituting the following—
"the Commissioner or such member or officer".

16. Section 26A(6) of the principal Ordinance is amended by inserting after Amendment of "Banks" the following-
", in the case of a person permitted to make monthly returns, on the last date of that return or, in any other case.".

17. The principal Ordinance is amended by adding after section 28 the Addition of new following-
"Goods imported
for processing or repacking for
export.
28A. (1) Where the Commissioner is satisfied that dutiable goods were imported solely for the purpose of further processing or repacking for export he may in writing grant permission for those goods to be delivered for that purpose to a place approved by him.
(2) The Commissioner may impose conditions in relation to permission granted under subsection (1) and may, in addition, require the owner of such goods to furnish such security, either in cash or by means of a bond, as the Commissioner requires to ensure---
(a) the due observance of conditions imposed under this
section;
(b) the export of the goods; and
(c) the safe and secure keeping of the goods in the place.
(3) Upon any failure to observe any condition imposed under subsection (2), any security furnished under that subsection shall be forfeited to the Crown, without prejudice to any other penalty which may be imposed.
(4) Notwithstanding subsection (3), the Governor in Council may entertain and give effect to any moral claim in respect of any security so forfeited.".
18. Section 35 of the principal Ordinance is repealed.

19. Section 37(c) of the principal Ordinance is amended by deleting "alter" and Amendment of substituting the following
section 37.
"without lawful authority alter or deface".
