An Ordinance to amend the Dutiable Commodities Ordinance.

Enacted by the Governor of Hong Kong, with the advice and consent of the Legislative Council thereof.

1. This Ordinance may be cited as the Dutiable Commodities (Amendment) Short title. Ordinance 1986.

2. The long title to the principal Ordinance is amended by deleting Amendment of “hydrocabon oils” and substituting the following-

"hydrocarbon oil".

Section 2 of the principal Ordinance is amended-

(a) in subsection (1)—

(i) by inserting after the definition of "permit" the following definition- ""place" means any area on land or water and includes any ship, aircraft, vehicle, train, building, structure or enclosure, whether movable or not;"; and

(ii) by deleting the definition of "transhipment cargo"; and

(b) by deleting subsections (2) and (4).

Amendment of section 2.

4. Section 3(1) of the principal Ordinance is amended by deleting "oils" and Amendment of substituting the following-

"oil".

5. Section 4 of the principal Ordinance is repealed and replaced by the Repeal and following-

4. (1) Duty shall be assessed and payable on dutiable goods and refunded in respect of such goods at the rates and in the manner set out in the Schedule.

(2) The Legislative Council may by resolution amend the Schedule and in particular, may amend it-

(a) to impose any duty on any dutiable goods or any class of

dutiable goods;

(b) to increase, decrease, recast, abolish, vary, waive or remit whether generally or particularly any duty imposed therein to any extent whatever;

(c) to impose new duties on any dutiable goods or class of dutiable goods, including goods that are already in Hong Kong at the time such new duties are imposed; or
