THE PARTITION ORDINANCE 1987

This Ordinance amends the Partition Ordinance to abolish the statutory requirement of making the Crown a necessary party to every partition action and to replace it with a requirement that all relevant documents be served on the Director of Buildings and Lands in the first instance.
2. Section 4 adds new sections providing for the means for the Director to obtain more time to assess the impact on Crown interests, if any, of the intended partition by filing a memorandum in Court upon which the proceedings will be stayed for a specified period of time; and also for the Attorney General to be joined as a party at any stage of the proceedings on his application.

Before the Acting Governor assented to the Bill in the name and on behalf of Her Majesty, the Attorney General advised that he could properly do so.
