for the Attorney General to join in the proceedings on behalf of the C only where Crown intervention is necessary. This is achieved by a req ment of service of documents to be prescribed by the Partition Rules on the Director of Buildings and Lands in the first instance, and making provision to enable the Attorney General to join as a party at any stage.

2. Clause 2 introduces an interpretation section which is con- sequential upon the amendments to the substantive law made by this Bill.

3. Clause 3 amends section 3–

(a) by removing the requirement for joining the Crown as a necessary

party; and

(b) by requiring notice of any addition of a party and notice of

judgment to be served on the Director of Buildings and Lands.

Clause 4 introduces-

(a) a new section 3A which enables the Attorney General to join in the proceedings at any stage. Section 3A(2) restricts the requirement of service on the Director of Buildings and Lands to cases where the Attorney General is not a party and provides for service only on the Attorney General after being added as a party; and

(b) a new section 3B which enables the Director of Buildings and Lands to file a memorandum in Court which shall have the consequence of staying the proceedings for a period to be pre- scribed by the rules, in order to obtain time for the assessment of the effect on Crown interests.

Clause 5 amends section 5 to require the party having the conduct of the proceedings to serve any order made under that section on the Director of Buildings and Lands.

6. Clause 6 confers on the Chief Justice power to make rules in respect of matters pertaining to procedure and other incidental matters.

本條例草案對土地分割條例作出修訂,主要目的在規定政府毋須在每一 宗土地分割訴訟中成爲「必須參與訴訟的當事人」,並規定律政司僅在政府認為須對 某宗訴訟加以干預時,才須代表政府參與訴訟。這些措施藉下述規定而達成,即 -規定在每宗土地分割訴訟開始時,當事人必須把土地分割規則所規定的有關文 件送達屋宇地政署署長,並規定律政司可以在訴訟的任何階段中介入成為訴訟當事 人。
