Clause 11
Viewing of films screened for purpose of censorship. The categories of persons who may be present at the screening of a film in addition to those authorized by the Authority has now been specified under this clause.

Clause 12 - Classification of films. There will be three categories of films. "Category II" films will be approved for exhibition subject to the condition that any advertising material associated must display the following notice : "NOT SUITABLE FOR CHILDREN ( 71 )" prominently and legibly both in English and in Chinese. The provision in the original "white" Bill whereby the censor could specify recommendations for inclusion on the certificate has been deleted since this was perceived as implying a fourth category of classification and was viewed with suspicion by the film industry representatives.
Clause 13 - Certificate of approval, notice of refusal to approve and notice concerning excision. This clause has been extensively recast. It confines the grounds upon which the Authority may revoke a certificate of approval to breaches of conditions of a certificate. It is also not proposed to limit the period of validity of a certificate of approval.

Clause 14 - Excised film to be retained by Authority. The provisions in respect of film excisions have been amended. This is necessary in light of the proposal to "delimit" the certificate of approval (clause 13). The Authority will be required to retain excisions for not less than 3 years and then dispose of them as he thinks fit. A distributor may reclaim the excised film on surrender of the relevant certificate(s) of approval. On such surrender, the certificate(s) of approval shall be deemed to be revoked.

Clause 15 - Copies of film to be excised. The provision for the Authority to take declarations as to copies of films held has been deleted. It is accepted that this provision achieved little by way of control.

Clause 18 - Action to be taken by Authority and censor in relation to advertising material which is not exempted. A strict time constraint (not later than 7 days after submission of the material) is placed on the Authority to appoint a censor and if, he thinks fit, not less than 2 advisers to examine material submitted (a similar time constraint is applied to material submitted for exemption under clause 17). The censor shall consult with any advisers appointed in making his decision, but is not bound by such advice.
