22.Clause 24 makes it an offence punishable by a fine of $50,000 and imprisonment for 1 year for any person to publish or display any advertising material which has neither been approved under clause 20 nor exempted under clause 21. It is a defence that a person charged did not know that any such advertising material had neither been approved nor exempted.

23. Clause 25 enables the Authority to recall any film which has been approved for exhibition under the Ordinance. Clause 26 provides that if the film is not produced; or if any film or soundtrack has been added to or excised or erased from the film, the Authority may revoke approval for exhibition.

24. Part VII deals with appeals and comprises clauses 27 to 29. Clauses 27 and 28 provide for appeals to a Board of Review chaired by the Secretary for Administrative Services and Information, against any decision of a censor or of the Authority. Clause 29 provides that any person who upon moral, religious, educational or other grounds is aggrieved by the exhibition of the film may, by notice in writing to the Chief Secretary, request that the film be reviewed by the Board. Upon any such appeal or review, the Board shall give the appellant, or the exhibitor of the film and the person requesting the review in the case of a review, the opportunity of being heard and, in relation to any such appeal or review, may give directions to the Authority with respect to the exercise by him of any of his functions under this Ordinance and the Authority shall comply with such directions.

25.Part VIll is miscellaneous and comprises clauses 30 to 38 and provides for offences; inspection and enforcement; the official censorship mark; risk and expense relating to the submission of film and advertising material for censorship; delegation of powers; the making of regulations; transitional matters and consequential amendments.

26. Clause 30 makes it an offence punishable, upon first conviction, by a fine of $10,000 and upon second or subsequent conviction, by a fine of $50,000 and imprisonment for 1 year, for an exhibitor to exhibit any film to persons under 18 years of age, that has been classified under clause 12 as approved for exhibition only to persons who have attained the age of 18 years. It is a defence that a person charged took all reasonable precautions before exhibiting the film to prevent the exhibition of the film to persons under the age of 18 years.

27. Clause 31 makes it an offence for a person to exhibit a film or display advertising material in respect of which a certificate of approval has been revoked or has become invalid or in respect of which a certificate of exemption has been revoked.

28. Clause 38 amends the provisions of the Places of Public Entertain- ment Ordinance specified in the Schedule, revokes the Film Censorship Regulations and makes a consequential amendment to the Television Ordinance.

29. The cost of the introduction of the filin classification system is not quantifiable at this stage, but it is estimated that the implementation of the inspection and enforcement provisions of the Bill will require the appoint- ment of 5 inspectors involving a recurring expenditure of $450,000 per

annum.

本條例草案目的如下:(甲)撤銷香港法例第172章公眾娛樂場所條例和 香港法例第172 章的附規例——亦即電影檢查規例——兩者內載關於電影檢查的 條文,另以新條文取代這些條款;及(乙)制訂一項新的影片分類制度。草案分為八 部份,共38錄,生效日期另行訂定。

草案第I部是總則,其中包括第1和第2條條文。

草案第2條就各詞的定義作出規定,其中包括「影片」一詞的定義在內.

4. 草案第II部列蔽第3、第4和第5條條文。上述條文規定設立電影檢查 監督,並規定成立電影檢查員小組,其成員由總督委任。電影檢查監督得委任電影 檢查員小組成員,以便他們依草案第9條規定進行檢查影片。

5. 草案第III 部載有第6條條文。該條規定:任何人士,如放映未經電影 檢查監督依草案第8條規定准予豁免遵守有關規定的、或未經電影檢查監督依草案 第15條規定批准放映的任們影片,即屬違法,可予判處罰款$50,000及監禁1年日!

草案第IV部列載第7至第10條條文。這些條文與影片檢查事宜有關。

草案第7條列明影片呈交電影檢查監督的各項手續。天ㄚ

8. 草案第8條規定:電影檢查監誓如認爲影片屬於一類宜於豁免遵守有關 規定的影片時,有權在不予檢查的情況下豁免該影片遵守有關規定,並批准其上 映。

9. 草案第9條列明電影檢查員在進行檢查影片時必須遵循的原則。電影横 查員必須按照本身的意見,以決定影片是否適宜公映,並在作出決定時,必須考慮 下列各項問題

(a)

影片在科學、文學、教育或藝術方面的價值有多少,或者,該片就社會 或文化理由所具價值或重要性有多少;

(6)

影片在塑造、描齡或處理殘暴、虐待、暴力、犯罪、恐怖、傷殘、性事 或猥褻的或令人生厭的語言或行為等方面的方式;

(c)

影片按照社會某階層人士的膚色、種族、信仰、宗教信仰、或種族來源 或原屬國籍、或性別而對該階層人士所作貶低或侮辱的嚴重程度;及

(d)

影片可能使本港與港以外地區良好關係受損的程度。

此外,電影檢查員對影片的聲帶——如有一 ·亦須一併加以觸及,並可 在獲得電影檢查監督批准後,諮詢他認爲可協助他對該影片作出評價的任何人士。 草案第10條容許電影檢查員以外的有關人士出席查看任何影片。
