Accordingly it is not only right and proper, but indeed necessary, that all legislative proposals by the Administration should be
carefully tested against the provisions of those Covenants.

Mr. Martin Lee demonstrated his concern by arranging to
obtain an opinion on the point from a leading academic writer, Dr.
Eric Barendt.

The question that is raised in this debate is not
whether any restrictions can lawfully be placed upon the enjoyment
of those rights. Article 19 itself sets out restrictions
permitted by international law.. The question is whether the
proposed power to restrict the exhibition of films could fairly be
regarded as falling within the scope of the restrictions permitted
by Article 19.
