UK/CANADA FILMS CO-PRODUCTION AGREEMENT
1.
According to NTD this Agreement has not been extended to Hong Kong. I can confirm also that it does not appear on the list of Bilateral Treaties in which Hong Kong has an interest which we handed to the Chinese in connection with our continuing consultations on international rights and obligations.

As you make clear in your draft the principal criterion is described in paragraph (4)(a) of the Annex. However Mr Drummond says that a Hong Kong producer could qualify under the Agreement provided he was resident in Great Britain thus I assume a Hong Kong BDTC could not qualify if he was only resident in Hong Kong.

As far as this Agreement's post-1997 application to Hong Kong people is concerned I imagine that this will depend on whether they retain British nationality after that date. As you know, many of them will do so, as British Nationals (Overseas), or even British Overseas Citizens, under the Hong Kong (Nationality) Order in Council. The fact that the Hong Kong Special Administrative Region will be under Chinese sovereignty from 1 July 1997 will have no bearing on this.

I think it is worth expanding slightly paragraph 5 of your draft to make this point.
