(3) Where the Authority exempts any film under this section he shall issue to the person who submitted the film a certificate of exemption in the prescribed form together with a copy of such certificate for cach copy of the film stated by such person under section 7(2)(a)(i) to be in his possession.

(4) No fee shall be payable for the issue of a certificate of exemption under this section.

(5) The Authority may revoke a certificate of exemption issued under this section in respect of any film by notice in writing served either personally or by registered post on the person to whom the certificate was issued if-

(a) a condition imposed under this section is contravened; or (b) in his opinion the public interest so requires,

(6) Where a certificate of exemption issued under this section is revoked under subsection (5), every copy thereof so issued shall be deemed to be revoked.

(1) Where any film is submitted to the Authority under section 7, films by censor. he shall, unless he exempts the film under section 8, appoint a censor to examine the film to determine whether the film is or is not suitable for exhibition.

(2) In determining whether any film is or is not suitable for exhibition a censor shall consider the following matters——

(a) whether and the manner in which the film portrays, depicts or treats, cruelty, torture, violence, crime, horror, disability, sexuality or indecent or offensive language or behaviour;

(6) whether and the extent to which the film denigrates or insults any particular class of the public by reference to the colour, race, creed, religious beliefs or ethnic or national origins or the sex of the members of that class; and

(c) whether and the extent to which the film is seriously prejudicial to

good relations with territories outside Hong Kong-

(3) In the case of a film that is intended to be exhibited, a censor, in cxamining the film, shall also take into consideration--

(a) the effect of the film as a whole and its likely effect on the audience

likely to view the film;

(b) the artistic, educational, literary or scientific merit of the film and

its importance or value for cultural or social reasons;

(c) the content of any accompanying soundtrack and its relationship

to the film; and

(d) in relation to the proposed exhibition of the film, the circumstances of such exhibition and the place and times at which the film is intended or is likely to be exhibited.

(4) In examining any film under this section a censor may, with the prior approval of the Authority in writing, consult any person whom he considers may be able to assist him in forming an opinion on which to base his decision in respect of the film.

(5) A prescribed fee shall be payable for the examination of a film under this section.

10. Where any film is viewed for the purpose of examination under Persons who this Ordinance, no person shall be present at the viewing other than a censor may attend and a projectionist and such other persons as the Authority may allow to viewings of attend.

11. Where any film is submitted to a censor for the purpose of Functions of examination under this Ordinance, the censor shall as soon as practicable censor. after viewing the film-

(a) approve the film for exhibition as provided in section 12;

(b) refuse to approve the film for exhibition as provided in section 13;

or

(c) deal with the film as provided in section 14.

12. (1) I, having taken into consideration the matters referred to in Approval and section 9(2), a censor is of the opinion that the film is suitable for exhibition classification of he shall approve the film for exhibition and classify it as—

(a) approved for general exhibition to persons of any age;

(b) approved for general exhibition to persons of any age subject to such recommendations relating to the viewing of the film by persons under the age of 18 years as he may consider appropriate;

or

(c) approved for exhibition only to persons who have attained the age

of 18 years.

(2) When classifying a film under subsection (1), a censor may, as part of his decision, specify for inclusion in the certificate of approval to be issued by the Authority under section 15–

(a) any recommendation relating to the suitability or unsuitability of

the film for exhibition-

(i) to the public in general; (ii) to any class of the public;

(iii) at a particular place;

(iv) at a particular time;

(v) for a particular purpose;

(vi) on one occasion;

(vii) on more than one occasion; and

(b) any description of the film,

as he thinks fit.
