Explanatory Memorandum
The principal objects of this Bill are to amend the Hong Kong Examinations Authority Ordinance to alter the composition of the Hong Kong Examinations Authority, and increase the powers of the Authority.
2. Clause 2 amends section 3 to-
(a) substitute for the provision that the Vice-Chancellors of the Uni- versity of Hong Kong and the Chinese University of Hong Kong or their representatives and the Director of Hong Kong Poly- technic or his representative should be ex-officio members of the Authority, a provision that the Vice-Chancellor of every university and the Director of every polytechnic, established in Hong Kong by enactment, and the President of the Hong Kong Baptist College, or their representatives should be ex-officio members;
(b) reduce the number of public officers to be appointed as such, to the
Authority, from 3 to 2;
(c) delete the provision for a nominee from the Board of Governors of the Hong Kong Polytechnic to be appointed to the Authority: (d) increase the number of principals of registered secondary schools
to be appointed to the Authority, from 3 to 5; and
(e) expand the category of persons who may be appointed to the Authority under subsection (2)(b)(ix) to include professional persons.
3. Clause 2 also amends section 3 to provide for the appointment of a Deputy Chairman to act during the absence or incapacity of the Chairman of the Authority and by making consequential amendments.

Clause 3 repeals section 6 which is no longer required.
5. Clause 4 amends section 7 to remove certain restrictions on the power of the Authority to conduct examinations, to fix fees and to enter into arrangements with educational institutions for the use of accommodation. personnel, facilities and services; to enable the power to appoint committees and set fees for examinations other than the specified examinations, to be delegated; and to make consequential amendments.
6. Clause 5 repeals and replaces section 8 to remove the reference to the first years for conducting the specified examinations. The existing subsection (2) becomes the new section 8.
7. Clause 6 inserts a new section 8A to provide specific authority for the Authority to publish or disclose examination results.
8. Clause 7 amends section 9 to add a further category to the list of the resources of the Authority.
9. Clauses 8, 9 and 10 change references to receipts and payments to references to income and expenditure in sections 10, 11 and 12. Clause 8 also deletes the proviso to section 10(2) and section 10(7) which are no longer required and clause 9 also removes the reference in section 11(1), to the accounts for the first financial year of the Authority.
10. Clause 11 inserts a new section 12A to authorize the investment of surplus moneys of the Authority.
11. Clause 12 replaces the Schedule to update the names of 2 of the specified examinations and to remove the references to the first years for conducting the specified examinations.
12. The Bill has no Public Service staffing or public expenditure implications.
