(4) Where an appeal is lodged under this section the decision, order, prohibi- tion, direction or other thing appealed against shall be complied with until the determination of the appeal.".

(a) In subsection (1), delete “Television" and substitute

"Broadcasting".

(b) Delete subsection (2) and substitute the following— “(2) The Governor in Council may deter- mine an appeal by confirming, varying or re- versing any decision, prohibition, order or direction of the Broadcasting Authority or by amending any Code of Practice.".

(a) In subsection (1), delete "Television" and substitute

"Broadcasting".

(b) In subsection (2A)—

(i) delete "Television" and substitute "Broad- casting";

(ii) delete "him" and substitute "it";

(iii) delete paragraph (b); and

(iv) in paragraph (c), delete “after 31 December 1980".

(c) In subsection (3)—

(i) delete "Television" and substitute "Broad- casting";

(ii) delete "he" in each place where it occurs and substitute "it"; and

(iii) delete "his" and substitute “its”.

(a) In subsection (1)—

(i) delete "Television" and substitute "Broad- casting"; and

(ii) delete "him" and substitute "it".

(b) In subsection (2), delete "Television" and substitute

"Broadcasting".

(c) In subsection (3), delete "of" where it first occurs

and substitute "or".

(a) In subsection (1)—

(iii) delete "he" and substitute "it"; and

(iv) delete "him" in each place where it occurs and substitute “it”.

(b) In subsection (3), delete "Board" and substitute "Broadcasting Authority or any committee ap- pointed thereby".

Amendment

Delete "On the advice of the Board the Television" and substitute "The Broadcasting”.

(a) In subsection (1)—–

(i) delete "before advising the Television Au- thority to prohibit" and substitute "the Broad- casting Authority shall, before it prohibits";

(ii) delete "the Board shall" and substitute a comma; and

(iii) delete "the Board" where it occurs for the second time and substitute "the Broadcasting Au- thority".

(b) In subsection (2)—

(i) delete "Board" and substitute "Broadcasting Authority"; and

(ii) delete "advise the Television Authority to".

Delete the section.

(a) In subsection (1), delete "On the advice of the Board

the Television" and substitute "The Broadcasting".

(b) In subsection (2)(d), delete "Television" and sub-

stitute "Broadcasting".

(c) In subsection (4), delete "Board" and substitute

"Broadcasting Authority".

Delete and substitute the following-

"Appeal to the

Governor in

Council.

38. (1) Subject to this section, a licensee aggrieved by-

(a) any decision of the Broadcasting Authority in the exercise of any discretion vested in it by or under this Ordinance (including any prohibition under section 35); or (b) anything contained in any Code of Practice or direction issued by the Broadcasting Authority, may appeal by way of petition to the Governor in Council.

(2) No appeal under subsection (1) shall lie against a prohibition-

(a) under section 35(1), except within 14 days after the date on which the licensee is notified of the prohibition under that section;

or

(b) under section 35(3).

(3) Any person named in an order under section 36 prohibiting the licensee from broadcasting material rendered, passed or selected by such person may appeal against the order by way of petition to the Governor in Council.
