When a post in a rank is required for
localisation or to facilitate constitutional change, if it is vacant otherwise than by the temporary absence of its substantive holder, and if an eligible officer has acted satisfactorily in the rank for six months during the preceding nine months, then the officer shall be confirmed as the substantive holder of that rank, so that his pensionable emoluments in that rank will be the pensionable emoluments upon which his benefits under the Scheme will be calculated. If the substantive holder of a post is on pre-retirement leave this paragraph shall apply to any eligible officer acting in the post in that period or part of it.

Where an eligible officer has other scheduled service, his eligibility for pension in respect of that other service and inter alia the pensionable emoluments to be used in computing the pension will depend on the pensions law relating to it.
Calculation of Compensation

An eligible officer under this Scheme will be eligible for compensation to be calculated and paid in accordance with the following provisions.

The compensation shall be calculated as a lump sum in accordance with the appropriate tables contained in the Appendix. Table IA and 1B apply to officers who are eligible officers in accordance with the provisions of sub-paragraph (a) of paragraph 2. Tables IIA and IIB apply to officers who retire in accordance with the provisions of sub-paragraphs (b), (c), (d) and (e) of paragraph 2. Tables IA and IIA apply to officers whose normal retirement age under the appropriate law is 55, tables IB and IIB apply to officers whose normal retirement age under the appropriate law is 60. tables take account of length of service up to ten years. The maximum amount of compensation payable under this Scheme shall be 4.76 times the annual value of MPS 48 at the time the compensation is due.

An eligible officer who is compensated under this Scheme on being superseded for promotion in the circumstances described in sub-paragraph (a) of paragraph 2 will not be eligible for any further payment of compensation on these grounds. Where such an officer is subsequently directed by the Governor to retire in accordance with the provisions of sub-paragraphs (c), (d) or (e) of paragraph 2 the compensation payable will be calculated by having regard to the difference between the factors for those required to retire and those superseded for his age at the date he is required to retire.
