(b) an officer is compulsorily retired in the exercise

disciplinary powers of punishment by the Govern- ment following a conviction of any offence referred to in paragraph (a),

the pension or allowance which has been granted to him may be cancelled, suspended or reduced, or he may not be granted a pension, gratuity or allowance, as the case may be.

(2) If after the retirement of an officer in circumstances in which he is eligible for a pension, gratuity or allowance but before the pension, gratuity or allowance is granted he is convicted and sentenced as specified in subsection (1)(a), any pension, gratuity or allowance eventually granted to him may be cancelled, suspended or reduced.

(3) For the purposes of subsections (1) and (2), the Governor may determine-

(a) whether a pension, gratuity or allowance shall be cancelled, suspended or reduced, or shall not be granted, as the case may be;

(b) the date from which the pension, gratuity or allow-

ance shall be cancelled, suspended or reduced; and

(c) in the case of a reduction in pension, gratuity or allowance, the amount of the reduction not exceed- ing 25 per cent of the pension, gratuity or allow-

ance,

and such determination shall be forthwith notified in writing by the Secretary for the Civil Service to the person or officer concerned.

(4) A person or officer who is aggrieved by any determi- nation under subsection (3) may, within 30 days of the noti- fication to him of the determination or such longer periods as the Governor may in any particular case permit, petition the Governor against the determination and the Governor may confirm, vary or reverse the determination as he thinks fit.

(5) Where a pension, gratuity or allowance is cancelled or suspended in accordance with a determination under sub- section (3), the Governor may direct that all or any part of the moneys to which such person or officer would have been entitled by way of pension, gratuity or allowance had he not been convicted and sentenced as specified in subsection (1)(a) or retired as specified in subsection (1)(b) be paid to, or applied for the maintenance or benefit, in the same manner in all respects as prescribed in section 13(3), and such moneys shall be paid or applied accordingly.

(6) Where a person whose pension or allowance has been cancelled or suspended or has been reduced in accord- ance with a determination under subsection (3) receives a free
