Amendment of

Widows and

Orphans

Pension

(Application) Regulations.

PENSION BENEFITS

(A) by deleting "air in pursuance of official instructions"

substituting the following-

"any means in pursuance of official instructions or in the course of his duties";

(B) by deleting "paragraph (1)(a) and (c):” and substituting

the following-

"paragraph (1)."; and

(C) by deleting the proviso;

(v) by inserting after paragraph (4) the following—

"(4A) Where an additional pension is granted under this regulation in respect of an injury which was caused in circum- stances creating a legal liability in some person other than the Government, the Government may take proceedings against such person to recover an amount not exceeding the amount of the additional pension multiplied by 14."; and

(vi) in paragraph (6) by deleting "Neither paragraph (1)(ii) nor paragraph (2) shall apply" and substituting the following-

"Paragraph (1)(ii) and (iii) and paragraph (2) shall not apply"; (aa) in regulation 33---

(i) by deleting "a pensionable" and substituting the follow- ing-

"an established";

(ii) by deleting "in the Colony" wherever it occurs and substi- tuting in each case the following-

"under the Government"; and

(iii) by deleting "Secretary of State" and substituting the follow- ing-

"Governor";

(ab) in the Schedule, by deleting "Republic of Southern Yemen" and

substituting the following-

"Peoples' Democratic Republic of Yemen".

50. The Widows and Orphans Pension (Application) Regulations shall be amended as follows-

(a) in regulation 2-

(36 of 1987.)

(i) in the definition of "holder of a pensionable office" by deleting "a pensionable” in both places where it occurs and sub- stituting in each case the following---

"an established"; and

(ii) by deleting the definition of "pensionable office" and sub- stituting the following-

"established office”, in relation to an officer, has—

(a) in case the Pensions Ordinance applies to the officer, the meaning assigned to it by section 2 of that Ordinance;

(b) in case the Pension Benefits Ordinance 1987 so applies, the meaning assigned to it by section 2 of that Ordinance;"; and
