Pensions
With pensions being made a right we have been giving some thought to the circumstances in which a pension might still be cancelled, suspended or reduced. We have decided to follow UK civil service practice in this regard with minor modifications to cater for Hong Kong's situation. For example, we shall include offences under the Prevention of Bribery Ordinance which attract custodial sentence as one of the circumstances in which a HK pension can be affected.
Among the circumstances in which a UK civil servant can lose his pension, if we have got it right, is for any offence in connection with the public service being an offence which is certified by a Minister to have been gravely injurious to the country or to be liable to lead to serious loss of confidence in the public service. We are proposing to include a similar provision. However, the Law Draftsman has asked to know how and in relation to what offences this provision is applied. We suspect that it does not relate to any specific criminal offences but rather to the circumstances in which an offence is committed. I should be grateful, however, if you could find out for us just how this provision is used.
