本法案並藉此機會作出數項輕微修訂,從而規定
(a)
凡提及「各次付款」一詞,都用「付款」一詞加以取代,因為原有條例亦作 出這項修訂;這樣,地方法院便可着令用整付一筆款項辦法,或每月付 款辦法,又或者兩項辦法一併使用(草案第二條、第四條、第五條和第 七條(6)段);以及
更正原有條例第十二條內一處漏提「第(1)款」這項錯漏(草案第七條(a) 段)。
Explanatory Memorandum
The principal Ordinance relates to affiliation proceedings for the main- tenance and education of an illegitimate child. This Bill amends the principal Ordinance-
(a) to empower the District Court to order a lump sum payment for the immediate and non-recurring needs of the child or for the purpose of enabling any liabilities and expenses reasonably incurred in maintaining and educating the child before the making of the order, to be met (clause 3(a)); (b) to remove the restriction on the amount of periodical payments that the District Court may award, the effect of which is that the Court may order such periodical payments as it thinks fit (clause 3(a) and (c)); and
(c) to make it clear that the power of the District Court to revoke, revive or vary an affiliation order does not extend to an order for a lump sum payment in one amount or for a lump sum to be paid in instalments where all such instalments have been paid (clause 6).

The opportunity is also taken to make a number of minor amendments- (a) to replace references to “payments" with references to “payment" as the principal Ordinance is now being amended so that the District Court may order a lump sum payment or monthly payments or both (clauses 2, 4, 5 and 7(b)); and
(b) to correct an omission of reference to subsection (1) in section 12
(clause 7(a)).

撤銷地方法院在判定定期付款額時所受限制;這項修訂的作用在使法庭 可以令有關人士採用法庭認為適當的定期付款辦法支付有關款項(草 案第三條(a)段和(c)段);以及
明確規定:地方法院撤銷、恢復或更改一項父職鑑定令的權力,對下述 已發出的命令並不適用,亦即有關用整付一筆款項辦法付款的命令,或 者,就各次分期付款都已如期繳付情況來說,有關可以分期攤付一筆原 須整付款項的命令(草案第六條)。
本條例草案對政府開支和人手需求方面都没有影響。
