CONDITIONS OF EMPLOYMENT FOREIGN DOMESTIC HELPERS IN HONG KONG

XCC (87) 29 (Copy at Annex), the Council advised and the Acting Governor ordered
-
(a)
that subject
(i)
(ii)
to it being made clear in the context of proposal 14(a), that there is по objection to a foreign domestic helper negotiating a new employment contract between termination on expiry of a contract and the date the helper is required to leave Hong Kong;

to the production of guidelines for the discretion, and the advice of the ICAC being obtained procedures for approving changes
of employment in exceptional circumstances specified in proposal 14(c);

it also being made clear that employees who
take part-time or full-time employment when they
have been permitted to enter Hong Kong to work for another person may be removed for being in breach of conditions of stay;

to particular care being taken in the implementation of proposal 14(d) with a view to ensuring that there is no undue disruption in the market for part-time domestic helpers; and
in the context of proposal 14(f), to there being provision for the minimum wage to be specified in new contracts and to be reviewed regularly, and to there being provision for wage rates to be increased in the second year of a contract to a rate not less than the then prevailing rate for new contracts;
