Transfer of part of Telco's concession and undertaking

In order to effect any transfer by Telco of any part of its concession (that is, its sole right to supply telephonic communication confirmed to it by section 3 of the Telephone Ordinance) or any part of its undertaking (including works, goods, cables and any other property belonging to the company) the consent of the Governor in Council is
is required under sections 34(1) and 35 of the Telephone Ordinance.

The Attorney General's Chambers have advised that such consent should be specific as to the parts of Telco's concession and undertaking to be transferred and the method of such transfer.
Proposal
6.
The following is a list of the parts of Telco's concession and undertaking which will need to be transferred by Telco to its subsidiary in order that this subsidiary may carry out the services listed in Annex A -
(a) the right to operate the services listed in
Annex A;

(c)
the basic asset types listed in paragraph 4 of Annex B; and
with the approval of the Postmaster General, such additional parts of Telco's undertaking as may be necessary for the transfer by Telco to its subsidiary of the services listed in Annex
A.
Annex B sets out the method of transfer of the relevant parts of Telco's concession and undertaking to its subsidiary.

If consent is given to the transfer by Telco to its subsidiary of the Darts of Telco's concession and undertaking listed in paragraph 6 above, in accordance with the method indicated in paragraph 7 above, then the Secretary for Economic
