(3) Following an amendment to a complaint, informa- tion or summons, the adjudicating magistrate shall-—

(a) read and explain the amended complaint, informa-

tion or summons to the defendant;

(b) give leave to the parties to call or recall and further examine such witnesses as may be reasonably re- quired by a party having regard to the nature of the amendment;

(c) grant such adjournment as may be reasonably necessary to enable the parties to call or recall witnesses and to prepare their cases;

(d) if he thinks fit, make an order that the complainant or informant shall pay to the defendant such costs, not exceeding $5,000, as may be occasioned by the amendment; and

(e) give judgment upon the substantial merits and facts of the case as proved before him, having regard to the offence charged in the complaint, information or summons as amended:

Provided that, if the amendment is made after the case for the complainant or informant is closed, no further evid- ence may be called by the complainant or informant other than evidence that would, apart from this section, be admissi- ble in rebuttal.

(4) In this section, “amend" includes the substitution of another offence in place of that alleged in the complaint, information or summons.".

An Ordinance to amend the Jubilee Sports Centre Ordinance.

Enacted by the Governor of Hong Kong, with the advice and consent

of the Legislative Council thereof.

1. This Ordinance may be cited as the Jubilee Sports Centre (Amend- Short title and ment) Ordinance 1987 and shall come into operation on a day to be commencement. appointed by the Governor by notice in the Gazette.

2. The long title to the principal Ordinance is amended by inserting Amendment of after "Sha Tin" the following---

long title.

Section 12 of the principal Ordinance is amended by deleting Amendment of subsection (1) and substituting the following-

"(1) The Board shall consist of the Financial Secretary or his representative and not less than 2 other members to be appointed by the Governor.

(IA) The Governor shall appoint a member of the Board to be Chairman of the Board.".

Section 16(4) of the principal Ordinance is amended by deleting Amendment of "and the Royal Hong Kong Jockey Club”.
