Amend the Motor Vehicles Insurance (Third Party Risks) Ordinance.
Enacted by the Governor of Hong Kong, with the advice and consent of the
Legislative Council thereof.
1. This Ordinance may be cited as the Motor Vehicles Insurance (Third Party Short title. Risks) (Amendment) Ordinance 1986.
2.
Section 8 of the principal Ordinance is repealed.
Explanatory Memorandum
This Bill repeals section 8 of the principal Ordinance which deals with the liability of insurers to pay hospital expenses incurred in relation to traffic accidents. Recovery difficulties have resulted in no action being taken under the section since 1981 as the revenue produced was less than the amount required to administer the scheme. It is also considered unfair to single out motor insurers to meet hospital costs in treating traffic accident victims while the treatment of other categories of accident victim entails no such liability.

The Bill has no Public Service stalling implications or, as the recovery scheme has been suspended, any public expenditure implications.

本草案撤地原有條例第八條,後者是關於承保人須要承擔有關交通 意外所引致醫院留醫費用的付款責任。由於執行該項計劃所得收益,比所需行 政費用還少,追討工作頗有困難,結果,自從一九八一年以來,有關方面就從 沒有援川該第八條的規定而探取行動。況且,規定汽車承保人須支付交通意外 受害人的醫院费用,而其他類別意外受害人的醫療責任,則未有所規定,這種 措施亦被視為有欠公平。
由於上述追討計副早已停止執行,故本草案對政府開支和人手需求 方面,都沒有影響。
