Addition of new section 55A.

3. The principal Ordinance is amended by adding after section 535 following-

"Indemnity.

55A. No liability shall be incurred by the Crown or any

officer as a result of anything done or omitted to be done by a public officer bona fide in the exercise or purported exercise of any functions conferred or imposed by or under this Ordinance.".

Explanatory Memorandum

Section 22 of the principal Ordinance requires insurers carrying on long term business to maintain an account in respect of that business. A fund is thus created which serves to protect the public on the winding up of the insurer in so far as the assets representing the fund fall within the jurisdiction of the Hong Kong courts. Certain foreign insurers whose main business is outside Hong Kong cannot comply with the Ordinance as it stands because of the law of their principal place of business or otherwise. The object of this Bill is to deal with the problem created by these insurers by enabling the Insurance Authority to authorize and require these companies to maintain an account in respect of their Hong Kong business only.

3. Clause 2 accordingly introduces a new section 22A into the principal Ordinance. The authorization of the Insurance Authority under the new section, apart from giving the necessary authority to the insurer, will contain provisions adapting the Third Schedule to the principal Ordinance to enable the assets of the Hong Kong fund to be identified and also to deal with transitional problems. The meaning of certain of the provisions of Part IV of the principal Ordinance is modified to give effect to the order.

4. Clause 3 of the Bill inserts into the principal Ordinance a provision whose object is to protect the Insurance Authority from claims for damages in connexion with the bona fide exercise of the Authority's functions under the Ordinance, including the functions conferred by new section 22A.

5. The Bill has no Public Service staffing or financial implications.

摘要說明

根據原有條例第二十二條的規定,經營長期保險業務的承保人,必 須經常備置有關業務的帳目。一項基金便是在這種情況下設立。基金的作用如 下:只要基金名下資產在本港的司法權限內,則一旦在承保人清盤時,公衆人 士的利益便會受到保障

至於若干外國承保人,亦即其主要業務在本港以外地方經營的承保 人,由於他們主要業務所在地的法律,或由於其他種種原因,因而不能遵守保 險公司條例內載的現行規定。本條例草案目的在處理這些承保人所造成的問題 ;辦法是使保險業監督授權和着令這些公司只備置其在本港所經營業務的帳目。

三、草案第二條相應在原有條例內增訂新條文第二十二A條。保險業監 督按該新訂條文規定而發出的授權令,除了賦予有關承保人所需的權力外,亦 可規定對原有條例第三附表作輕微修改,從而使該名承保人在本港所設立基金 的資產得予識別,並使過渡性問題亦得予處理。本草案對原有條例第四部內載 若干條款的涵義略作修改,以便把上述命合付諸實施。

四、 草案第三條在原有條例內加插一項規定,目的在使保險業監督獲得 保障,免受追討賠償;但是,該項保障僅適用於與該監督真實行使本條例賦予 他的職權有關情事,包括行使新訂第二十二A條所賦予他的職權有關情事在內。

五、 本草案對政府財政和人手需求方面都沒有影響。
