Clause 14 amends existing section 17B(1) (a) to provide that an identity card which has been invalidated will not be regarded as a documentary proof of identity for the purposes of this Ordinance. Clause 15 makes minor revisions to section 17C(4) (a) because of proposed amendments to the Registration of Persons Ordinance (see paragraph 24 below).

Clauses 17 to 19 amend the deportation provisions in sections 20 to 22 to provide for the immunity from deportation of persons who are at present defined as "Chinese residents". These persons will become Hong Kong permanent residents and will be non-deportable when the amending legislation comes into force.

Clauses 21 and 22 amend section 53 and section 53A to provide that a person who has appealed to the Registration of Persons Tribunal and has been determined by the Tribunal to be a person who does not enjoy the right of abode in Hong Kong shall not be able to appeal further on the same ground under section 53 or section 53A of the Immigration Ordinance. The reason for this amendment is explained in paragraph 33 below.

Clause 27 replaces the existing First Schedule (which lists the categories of "Hong Kong belonger") with a new First Schedule (which lists the categories of "Hong Kong permanent resident"). With the exception of a numerically insignificant category of "Hong Kong belongers" who were formally included in it although they have ceased to be British Dependent Territories citizens (such as persons born. in Hong Kong who have renounced their British nationality), the revised schedule includes all persons who are at present "Hong Kong belongers" and all persons who are at present "Chinese residents". Those "Hong Kong permanent residents" who are BDTCs by virtue of a connection with Hong Kong are described by referring to Article 2 of the

the Hong Kong (British Nationality) Order 1986, copy at Annex C.

Clause 28 makes certain consequential amendments to other enactments as a result of the replacement of the terms "Hong Kong belonger" and "Chinese resident" by the term "Hong Kong permanent resident". Apart from the Electoral Provisions Ordinance (Chapter 367), the amendments will not alter the effect of those provisions. In the case of the Electoral Provisions Ordinance, the amendment has the effect of slightly widening the eligibility to register as a voter by exempting people who are now defined as "Chinese residents" from satisfying the
