Against this background, it is proposed to define the term "right of abode in Hong Kong" to include all the four elements listed in paragraph 6, that is right to land, freedom from conditions of stay,

from conditions of stay, freedom from removal and freedom from deportation. The inclusion of freedom from deportation in the concept of "right of abode" will give people holding that right an explicit assurance that their future residence Hong Kong is secure.

The immediate purpose of introducing the term "right of abode in Hong Kong" is to enable the issue from 1 July 1987 of permanent identity cards stating the holders' right of abode in support of endorsements to be included in BN(0) passports and C of Is. To meet this immediate purpose, the right of abode in Hong Kong as defined will be accorded to all "Hong Kong belongers" and "Chinese residents" only, but not to "resident British citizens" and "resident United Kingdom belongers". The latter two categories will not hold BN(0) passports or C of Is in which it is necessary to insert a right of abode endorsement. They will continue to enjoy the right to land in Hong Kong.

As "Hong Kong belongers" and "Chinese residents" will enjoy precisely the same legal status and rights under the amending legislation, it is proposed to replace these two terms by a new expression "Hong Kong permanent resident". change in nomenclature has the advantages of

(a) removing a definitional distinction between "Hong Kong belongers" and "Chinese residents" which could be confusing when both groups of people would enjoy the same legal status and rights under the amending legislation. Instead a distinction will be drawn between, on the one hand, "Hong Kong permanent residents" and, on the other hand, all others; and

(b)

introducing a convenient term to refer to any person who would have

have the right of abode in Hong Kong and would be eligible for a permanent identity card stating that right. The term "Hong Kong permanent resident" (ZER would be widely accepted and understood internationally.
