For the avoidance of doubt, it
is hereby declared that a statutory
declaration made under subsection (4)(b)
at any time prior to the commencement
of the Powers of Attorney (Amendment)
Ordinance 1987 shall not be invalid or
otherwise ineffective for its purpose
solely by reason of the fact that it
was made before a solicitor mentioned
in subsection (8) or his partner, clerk
or employee.

Explanatory Memorandum
This Bill amends the Powers of Attorney Ordinance
to remove doubt as to the validity of a statutory
declaration made by a donee of a power of attorney for the
purposes of section 5(4) and to provide that no such
statutory declaration made after the commencement of this
Bill shall be sufficient if taken and received by a
solicitor acting for the donee or any person involved in
the transaction to which the statutory declaration relates
or by a partner, clerk or employee of that solicitor.
