the relocation of the proposed footbridge for a distance of about 4 metres westward

of the Roads
Under Section 11(5)
(Works, Use and Compensation) Ordinance (Chapter 370) (hereinafter referred to as "the Ordinance"), the Governor in Council may, after the expiry of at least 28 days notice on any person affected, amend any plan and scheme already considered and authorize the works and use in accordance with that amended plan
plan and scheme. Section 2(2) of the Ordinance requires the notice to be served on any person affected by hand or by registered post.

The proposed amendments do not, however, involve any change in the nature of the authorized works and the use described in the Scheme already considered and in respect of which the general public has been given an opportunity to object when the Scheme was published under section 8 of the Ordinance, but merely seek further power to close portions of the footpaths and segregation islands on Connaught Road West and On Tai Street to facilitate the execution of the works and the use already authorized.

The proposed amendments to the Morrison Street Footbridge will not adversely affect access from both Lot ML 426, which is on the west side of On Tai Street, and from the Western Market onto On Tai Street. Highways Department has advised that,
(a)
only that part of On Tai Street occupied by the proposed footbridge and temporary steel staircase will be closed during the construction of the works and that a covered walkway of a minimum width of 1.5 metres
