With the exception of noise from air conditioning or ventilation equipment (which is currently controlled by the Urban Services Department and Regional Services Department under section 12 of the Public Health and Municipal Services Ordinance, Chapter 132) noise from factories, trade or business premises, or indeed premises other than residential premises or construction sites, is not directly subject to control at present.

Strictly speaking,
any
the subjective nuisance provisions that operate late at night under the Summary Offences Ordinance (see paragraphs 7 and 8 above) could be used to control this form of noise. However, these provisions are too general to be of real use in controlling noise from factories, and the police have difficulty in proving the existence of a nuisance in such cases.
