MEMORANDUM FOR EXECUTIVE COUNCIL

DRAFT NOISE CONTROL BILL

INTRODUCTION

The purpose of this memorandum is to seek members' advice on whether the draft Noise Control Bill (at Annex A) and the draft Technical Memoranda at. BACKGROUND

At present there is no comprehensive legislation for the control of noise pollution. In 1975, consultants were employed by the Government to make recommendations on the organizational and legislative framework for pollution control and environmental protection in Hong Kong. As a result of the consultants' recommendations, comprehensive legislation has been enacted in three of the four major fields of environmental protection, viz. water pollution, air pollution and waste management. The Waste Disposal Ordinance (Chapter 354) and the Water Pollution Control Ordinance (Chapter 358) were enacted in 1980 and the Air Pollution Control Ordinance (Chapter 311) was enacted in 1983. The preparation of draft legislation in the remaining field of environmental protection, i.e. noise, is now complete.

THE PROPOSAL

The aim of

the draft Noise Control Bill is to produce comprehensive legislation which draws together many of the existing controls in other Ordinances. It also seeks to extend the scope of legislative control over environmental noise.

The draft Bill deals with the following forms of noise :

(a)

noise from domestic premises and public places (often referred to as general neighbourhood noise);

(b)

noise from construction

activities

(including piling);

(c)

noise

public places (e.g.

from places other

than

construction sites, domestic premises or

noise

from

industrial or commercial premises); and
