noise emanating from places other than domestic premises,

public places or construction sites.

5. Following the lines of the relevant provisions of

the Summary Offences Ordinance and subsidiary legislation

made thereunder (Cap. 228), which provisions will be

repealed by this Bill, it will be an offence to make noise

which disturbs public tranquillity or causes a nuisance to

any person between prescribed hours or on any general

holiday (clause 5), to make noise at any time in particular

circumstances which disturbs public tranquillity or causes

a nuisance to any person (clause 6) and to use powered

mechanical equipment, or carry out prescribed work between

7

p.m. and 7 a.m. on any two consecutive days, or on a

general holiday or carry out percussive piling at any time

between the hours of 7 a.m. and 7 p.m. other than under a

construction noise permit issued for that purpose or to

carry out percussive piling between the hours of 7 p.m. and

7 a.m. on any two consecutive days or on a general holiday

(clause 7). The definition "construction work" includes

all types of construction work, quarrying and the use of

machinery and material for such work.

6. Clause 9 of the Bill deals with applications for

construction noise permits and the issue, refusal to issue,

renewal, cancellation or variation of such permits. A

permit may be cancelled or varied if any condition to which

it is subject is contravened or, where an Authority

considers it necessary in the public interest. Clause 10

enables the Secretary for Health and Welfare to prepare
