(b) if the application has been made in respect of
construction work for the time being prescribed
for the purposes of section 8; or
(c)
if the issue of a construction noise permit would
be contrary to any principle set out in a
Technical Memoranda issued from time to time
under section 10(1).
(5) Where the Authority issues a construction noise
permit under subsection (1), the Authority shall serve
written notice of that decision on the applicant and where
the construction noise permit is issued subject to
conditions
(a) shall specify in the notice the conditions to
which the construction noise permit is subject;
and
(b)
shall
-
(i) adequately state in the notice the
reasons for the imposition of such conditions; or
(ii) advise in the notice that if the
applicant objects to the imposition of such
conditions an adequate statement of reasons will
