Prisoners released under supervision
We have learned recently that three months ago (17 March) there appeared in "The Times" a report of a piece of litigation in the European Court of Human Rights concerning the above subject. We understand that the Court has been asked to rule that where a prisoner has been released under supervision (i.e. on parole) the execution of a recall order is a breach of that prisoner's right to have the lawfulness of his imprisonment determined by a court.
As we are in the process of putting together a bill to enable a parole scheme to be introduced into Hong Kong the outcome of this litigation would be of considerable interest to us. Do you think you could make enquiries with the Home Office to see whether they have any details of it?
