OVERSEAS TERRITORIES ORDER
1 As promised, I attach a first draft of an Order to extend the 1985 Act to certain overseas territories.

2 The extension of 2 and 13 of the 1985 Act caused me the most difficulty, and as you will see the solution I have proposed is that in each territory the UK (and indeed the Channel Islands and the Isle of Man) should be treated just
As I understand as if it were a separate Contracting State. it, however, you would not be able to reciprocate in the UK, and this leads to the question of how in this respect the Territories should be treated in the UK. You mentioned that the Family Law Bill contains a provision for extension to overseas territories; has this yet been cleared with the FCO? I should be grateful for your comments on these points.
3 You will see that I have had to provide for Governors to supplement the provisions of the Act through orders (see section 9, 20(2), 25(3) and 27(1), although perhaps not, subject to the views of the territorial authorities, section 11); I think that this is inevitable, given the fact that the
legislation on the matters in question will all be contained in local Ordinances, but it does mean that until the Governor of each Territory has made the necessary orders we cannot extend the Conventions to that Territory.
