Amend the Interpretation and General Clauses Ordinance.
Enacted by the Governor of Hong Kong, with the advice and consent of the
Legislative Council thereof.
1. This Ordinance may be cited as the Interpretation and General Clauses Short title. (Amendment) Ordinance 1986.
2. Section 90 of the principal Ordinance is amended-
Amendment of section 90.
(a) in subsection (1) by deleting “(2) and (3)” and substituting the following (Cap. I.)
“(2), (3) and (4)”;
(b) in subsection (2)-
(i) by deleting paragraph («); and
(ii) by deleting "attempt."; and
(c) by inserting, after subsection (3), the following--
"(4) Where a person is convicted of the offence at common law of conspiracy to defraud, he shall be liable to imprisonment for 14 years.”.
Explanatory Memorandum
The main purpose of this Bill is to increase the penalty for the common law offence of conspiracy to defraud. The Bill also removes the superfluous references to
attempts to commit an offence, in section 90(2) of the principal Ordinance.
2.
The Bill has no public finance or Public Service staffing implications.
