EEC/EFTA WORKING PARTY ON A PARALLEL CONVENTION TO THE 1968 EC JUDGMENTS CONVENTION

1.

You have received a copy of Mr Carpenter's letter to me of 23 December and enclosures. So have all copy addressees of this minute except for Ian Hendry, to whom I am copying the letter but not the enclosures.

2. We have to produce, for discussion on 26 January, a contribu- tion to a paper to be presented to the EFTA countries on behalf of all the EEC countries, though it will only be those with dependent territories who will contribute. 1 suggest that we aim to have our contribution ready for Mr Carpenter by Friday 16 Janaury. The points on which our contribution is requested are listed at (a) (d) at the top of page 2 of Mr Carpenter's letter, together with the further question from Norway concerning the appeal structure.

We need to be sure, As to (a) we already have the list. however, that we do not cut ourselves off from the possibility of adding further territories to it. There should be no question of making the list exhaustive at this stage of the negotiations. to (b) (constitutional relationship), (c) the information on the judicial system, and the question on the appeal structure, propose to put together brief answers,in conjunction with Mr Hendry

As far on his return, covering all the West Indian Territories. as Hong Kong is concerned, I have spoken to Mr Leeks, who is sending me a copy of the standard brief on the constitutional position and of the relevant parts of the constitution dealing with the judicial system and appeals. I am assuming that we do not have to supply information on European territories, but will check with Mr Carpenter. *

4. I should be grateful if you and Mr Leeks could supply the relevant information on languages to answer point (a).
