Simplified procedures for obtaining possession

4. Clause 6 amends section 101 of the principal Ordinance so that simplified procedure to obtain possession in the case of demised premises that are deserted leaving no sufficient distress to satisfy arrears of rent shall apply to premises with a rateable value not exceeding $30,000. The Legislative Council is empowered to amend by resolution the level of rateable value.

5. Clause 4 amends section 75 to provide a definition of “rateable value" and clause 5 enacts section 75A to enable the rateable value to be proved by certificate.

6. Similar amendments are made in clauses 7 to 13 in respect of simplified procedures for obtaining possession in the case of premises unlawfully held over (section 129) and illegal encroachment (section 132).

Delegation of certain of Commissioner's powers

Clause 14 amends section 136A to enable the Commissioner to delegate to public officers in his department his powers under that section to remit or refund fees.

七、草案第十四條修訂原有條例第一三六A條,從而容許差餉物業估價 署署長把該第一三六A條賦予他的權力,亦即關於寬免繳納款項或退還款項的 權力,授予他的屬下公務人員執掌。

一九八六年業主與住客(綜合)(修訂)條例草案

摘要說明

當局對原有條例的實施情況經常加以檢討,而本草案對原有條例所 作修訂,是基於有關的檢討結果而作出。

增加租金

二、 草案第二條規定:凡須依原有條例第一部條文規定而繳交的租金, 現予調高至相等於標準租金的30倍。

三、草案第三條規定:就原有條例第二部內載的若干情況來說,可以按 照第五十八條第(2)款所述辦法而加租的加幅,現予調高。

簡化收回樓宇手續

四、 草案第六條修訂原有條例第一○一條,從而簡化收回下述樓宇的手 續:已被棄置而其內所留下可供當局扣押物品的價值不足以清繳欠租的樓宇。 經簡化後的手續對應課差餉租值不逾$30,000的該類樓宇都適用。此外,該第 八條亦規定:立法局有權決議案而修訂該項應課差餉租值額。

五、 草案第四條修訂原有條例第七十五條,從而界定「應課差餉租值」 一詞的涵義。草案第五條制訂新條文第七十五A條,從而規定:應課差餉租值 可藉證明書加以證明。

草案第七至第十三條對原有條例內有關條文作出類似修訂,以便 上述關於收回樓宇的簡化手續亦適用於租約期滿後仍遭非法佔用的樓宇(原有 條例第一二九條)和遭非法侵佔的土地(原有條例第一三二條 )。
