Enclosure No.
2
THE LANDLORD AND TENANT (CONSOLIDATION) (AMENDMENT) ORDINANCE 1986
(No. 37 of 1986)
This Ordinance contains the results of the
most recent annual review of the operation of the law relating to landlord and tenant. It -
(a) increases the level of permitted rent for
Part I (pre-war) tenancies, and the size of permissible rent increases in respect of Fart II (post-war) tenancies; and
(b) extends to premises with a rateable value
of up to $30,000 those provisions that enable possession to be obtained by a simplified procedure where the premises are deserted, or are unlawfully occupied. The former limits were set in the last century and were so low that the provisions no longer had any practical application.
2.
Other amendments made by the Ordinance are minor and either relate to the delegation of the power of the Commissioner of Rating and Valuation or are consequential.
3. Before the Governor assented to the Bill in the name and on behalf of Her Majesty, the Attorney General advised that he could properly do so.
