The Hong Kong
Indians,
the subject matter of this
Petition, are at present BDTCS under
the
British
Nationality Act 1981 ("BNA").
5.1
BDTCS, who enjoy such status by virtue of a
connection with Hong Kong only, will lose that citizenship
on the Transfer Date (Order Article 3).
5.2
Such persons will have the right to acquire or
retain (if formerly acquired as from 1st July 1987) a new
British National Overseas ("BN(0)") (Order
status of
Article 4).
5.3
Those BDTCs who have not
will
acquired BN (0) status
automatically acquire the status of British Overseas
Citizens ("BOC") on the Transfer Date if they would
otherwise be stateless. (Order Article 6 (1)).
5.4
Children of former Hong Kong BDTCS born on or
after the Transfer Date will acquire BOC status at birth if
they would otherwise be stateless.

5.5
Grandchildren of former Hong Kong BDTCs born on or
after the Transfer Date will be entitled to register as
BOCS if they would otherwise be stateless.
