6.119 These proposals are about to be put to the Executive Council. Drug trafficking is a complex problem and the brief summary of the proposals presented does not include the major problems that exist in formulating and introducing new legislation on these lines.

6.120 If some means can be devised for attacking the proceeds of drug trafficking it will also strike at triad activity. Further if the measures for forfeiture are successful, consideration could be given to extending the measures to other areas of triad activity.

In summary, the options are

attendance of suspects at

identification parades, both face to face and using one-way viewers, could be required by law [paragraphs 6,2 to 6.12];

section 33 of the Crimes Ordinance, Chapter 200, could be amended to make it applicable to all written witness statements which carry an endorsement in clear terms and are prepared with a view to criminal proceedings in any court - Magistrates, District or High Court [paragraphs 6.14 to 6.17];

section 32 of the Crimes Ordinance could be amended so that is completely clear that the sanctions under that section apply to statements taken by the Police from witnesses whom they require to be sworn [paragraphs 6.18 to 6.19];

section 39 of the Crimes Ordinance could be extended to include sworn statements made prior to trial by deeming them to be statements made in judicial proceedings, for the purpose of that section [paragraphs 6.20 to 6.21];

section 34 of the Societies Ordinance, Chapter 157, could be amended to make it more effective by creating realistic penalties for not answering truthfully the questions of the Registrar

[paragraphs 6.42 to 6.48];
